The allegations of the answer upon which the parties went to trial were in substance that tobacco growers who were citizens and residents of Ohio aggregating at least three-fourths of the producers of Burley tobacco in Ohio had signed contracts which were substantially identical in terms, the purpose of which was to bind the signers, including the defendant, “to agree in a manner to keep the price of such tobacco raised in Ohio at a fixed and graduated figure in Ohio by which the price of said tobacco between themselves and others should be so as to preclude a free and unrestricted…
