Petition, pursuant to CPLR article 78, transferred to this court by order of the Supreme Court, New York County (Edward Greenfield, JO, entered February 15, 1989, seeking to annul a determination of respondent New York City Police Commissioner dated June 12, 1988 which dismissed petitioner from his position as a police officer, unanimously dismissed and the determination confirmed, without costs.

In reviewing the record, we find that there was substantial evidence to support the Commissioner’s determination that petitioner, while acting in concert with other police officers, inter alia,…
