BROOKS, Judge.
T. M. Glascow, C. M. Winters, Ed Hynds, and W. O. Taylor, were jointly indicted for theft of property over the value of $50, under article 858, Penal Code, of this State. On the trial there was a severance, and Glascow and Winters were placed upon trial, and were convicted of said offense, and the punishment of Glascow was assessed at two years confinement in the penitentiary, and that of Winters assessed at four years confinement in the penitentiary, under article 869 of the Penal Code.
