Defendant was convicted of the crime of rape on November 23, 1951. The trial court set December 15, 1951, as the date for the imposition of sentence. In the meantime, defendant has perfected his appeal to this court from an order denying his motion for judgment notwithstanding the verdict or for a new trial. He is at liberty under an appeal bond in the sum of $5,000, conditioned upon his appearance “before the District Court of the County of Clay and State of Minnesota, on the 8th day of December, A.
