MEMORANDUM OPINION AND ORDER

MOYER, United States Magistrate Judge.

This action is before the court upon the defendant’s motion for partial summary judgment (DN 8) and the plaintiffs’ motion for partial summary judgment (DN 10).

I. FACTUAL BACKGROUND

Lesha Allen, a plaintiff in this action, purchased and maintains an insurance policy (the “policy”), which includes uninsured motorist (“UM”) coverage, from the defendant insurer, Safe Auto Insurance Company (“Safe Auto”).
