Appeal from a judgment of the County Court of Clinton County (Feinberg, J.), rendered December 11, 1984, upon a verdict convicting defendant of the crime of sodomy in the first degree.

On September 10, 1984, defendant was charged in a single-count indictment with sodomy in the first degree. At trial, the victim testified that on the afternoon of August 20, 1984, she, defendant and three companions entered a cemetery in the City of Plattsburgh to drink a case of beer.
