Appeal from a judgment of the Supreme Court. The action was brought by the plaintiffs, as judgment ■ creditors of the firm of Nace & Co., to set aside an assignment in trust for the benefit of creditors without preferences, _of the assets of that firm. The complaint was framed to set aside the assignment on the ground that it was made to hinder, delay and defraud the creditors of the assignors, and it contained no charge that the assignment had failed for want of power to execute it, or otherwise.
