This suit was brought, under Article 61 of the Code, by the appellants, the widow and infant children of George C. Cox, a lineman of the Chesapeake and Potomac Telephone Company, for damages resulting from the alleged negligence’ of the defendant, causing the death of the said George 0. Cox while in the employment of the said Chesapeake and Potomac Telephone Company.

In addition to the general issue plea, the defendant filed a further plea in which, briefly stated, it is alleged that the plaintiffs had previously instituted, in the Court of Common Pleas of Baltimore City a suit against the…
