This was an action of trespass on the case, brought by J. M. Berkely against the Oheasa.peake & Ohio Railway Company, a corporation, in the Oircuit Court of Cabell county, on the. 80th day of August, 1898, to recover damages for an injury alleged to have been inflicted upon the plaintiff while crossing the track of said railroad in the city of Huntington, on Heventh street, in this: that the defendant, by its servants and agents, negligently drove its locomotive engine and tender against the plaintiff with great violence, and threw the plaintiff with great force upon…
