The plaintiff, a former Vicksburg, Mississippi school teacher, contends that local school officials, in dismissing him without complying with the notice and hearing provisions of the state Public School Fair Dismissal Act, Miss.Code of 1972, §§ 37-9-101, et seq., unconstitutionally deprived him of a property interest without due process of law. The court below granted summary judgment for the defendants, holding that the plaintiff had no “legitimate expectancy” of continued employment that would be protected by the Due Process Clause.
