Appellant, Alfred F. Fritz, appeals a summary judgment awarded to the appellees, The Regents of the University of Colorado and Colorado General Hospital, on the grounds that appellant’s complaint was defective for failure to comply with section 24-10-109, C.R.S. 1973. We affirm.

On July 12, 1973, appellant entered Colorado General Hospital for a total hip replacement.
