— Charles J. Blackburn, appellant herein, was convicted of the murder of one Miguel Bernal and the death penalty imposed. From this judgment and the order overruling his motion for a new trial he appeals.
The sufficiency of the evidence to support the verdict is not raised, but the disposition of the questions presented by the assignments will more readily appear if a rather full statement of the facts is given.
