Miller, as state tax collector, filed this suit in the circuit court of Coahoma county against the county, seek- ' ing to recover for the use and benefit of the city of Clarksdale, Mississippi, the sum of thirty-five thousand one hundred forty-two dollars and twenty-one cents, alleged to be due the said city on account of ad valorem taxes collected by the sheriff and tax collector of Coa.homa county for the years 1925,1926, and 1927, and paid into- the county treasury.
