W.A. Rogers brought this suit to cancel the claims of the State of Mississippi to approximately 1080 acres of land in Simpson County as a cloud on his title.

The bill alleges that the State's claim is based upon pretended tax sales by the tax collector of Simpson County, one dated April 6, 1936, wherein certain of the lands were sold, and the other dated September 19, 1938, wherein the remainder of the lands were sold, and at both sales the land was sold to the state.
