GROOMS, District Judge.

This case is before the Court on motions for summary judgment.

In March 1973, plaintiff James & Hack-worth entered into a contract with Westchester Apartments, Ltd. and Haversham Townhouses to provide plans and specifications for apartment projects to be constructed in Jefferson County, Alabama. Plaintiff Rives Construction Company, a partnership, was a general partner in West- Chester and Haversham.
