Dell Scott, the appellant, commenced an action against the Economy Mercantile Company, a corporation, and A. Menin, for the purpose of reforming a bill of sale covering personal property, claiming that it was intended to he a mortgage and that he had one year within which to redeem, and asked for possession of the personal property or judgment for $838, claimed by the appellant to be the difference in value between the value of the property pledged and the amount owing to the appellees by the appellant.
