Action by the appellant against the appellees, and judgment for the defendants.

The assignments of error bring in question the correctness of the rulings of the court in overruling the demurrers of appellant to the first, third, fourth, fifth and sixth paragraphs of the answer, and in overruling the motion of the . plaintiff for a new trial.

In the first paragraph of the complaint it is alleged, that the plaintiff is a daughter and heir of Edmund Nutt, deceased, late of said county, who died in 1863, intestate, *536being seized in fee simple of two thousand acres of valuable' lands, which descended…
