Appeal by the defendant, The Greenwich Insurance Company of the city of New York, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Monroe on the 30th day of March, 1896, .upon the verdict- of a jury, and also from an order entered in said clerk’s office on the 22d day of January, 1897, denying the defendant’s motion for a new .trial made upon the minutes.

Adams, J.:

The plaintiff, through the medium of this action, seeks to recover damages for an alleged breach of contract.

It is conceded that on or about the 31st of December, 1887, the parties entered into a written agreement, by the terms of which the plaintiff was appointed the general agent of the defendant for certain specified portions of the States of New York and Pennsylvania, with power to appoint sub-agents in the territory assigned to him, subject, however, to the approval of the defendant.
