Breault v. Chairman of the Board of Fire Commissioners
Massachusetts Supreme Judicial Court
1Opinion of the CourtLiacos, J.
A judge of the Superior Court concluded, in a pretrial order, that, even though the acts complained of by the plaintiff were performed by the defendant solely in his capacity as a public official, he is not immune from liability under the Federal or State civil rights laws, 42 U.S.C. § 1983 (1982) and G.L. c. 12, §§ 11H and 111 (1986 ed.).2 The judge also *28denied the defendant’s motion for summary judgment. The defendant appeals. We conclude that the judge did not err either as to the Federal or State civil rights claim in denying immunity to the defendant. Accordingly, we affirm.
