MEMORANDUM RULING
STAGG, Chief Judge.
I. INTRODUCTION
On September 11, 1983, Charles Frederick Biggs, Jr., plaintiff’s deceased son, entered the Veterans’ Administration Medical Center (“VA”) in Shreveport, Louisiana for elective surgery to his right shoulder. Biggs was given pre-operative medication and prepared for surgery on the morning of September 15. He was strapped on a gurney with its side rails in the up position. Biggs was then wheeled to the hallway outside the surgical area and was left there while the operating room was being prepared.
