HENDERSON, Judge.

The appellant in this case was convicted of forgery, and his punishment assessed at four years in the penitentiary, and from the judgment and sentence of the lower court he prosecutes this appeal.

There are but two assignments of error necessary to be considered in this case. The first is the action of the court in overruling the motion for a continuance. Appellant asked the continuance in this case on account of the absence of one William M. Cook, whose residence he states he did not know, but that he had used due diligence to find out where said witness could be found; that…
