WYCHE, District Judge.
This action was brought by the plaintiff United Textile Workers Union of America, Local 120, for specific performance of the arbitration agreement contained in its collective bargaining agreement with the defendant Newberry Mills, Inc., wherein the plaintiff sought arbitration of the question of whether or not eighteen of its members were lawfully discharged as the result of an alleged “wildcat strike”. The action arose under Section 301 of the Labor Management Relations Act, 29 U.S.C.A. § 185, and under the Federal Declaratory Judgment Act, 28 U.S.C.A. §§ 2201 and 2202.…
