This matter comes before the court on the plaintiff’s motion for summary judgement. Continental Casualty Company (“Continental”), an insurer of the asbestos manufacturer, Fibreboard Corporation (“Fi-breboard”), has brought an action seeking declaratory judgement that it is not obligated to indemnify Fibreboard for punitive damages awarded against Fibreboard in jury trials conducted in West Virginia and Texas.
