W. D. Short, operator of a saltwater disposal well, brought an action to recover damages from Gary K. Wise, the landowner, for wrongful interference with his right to use the disposal well. A bench trial was conducted and the court awarded damages to Short in the amount of $46,905.40 for breach of contract, trespass and unjust enrichment. Wise appeals, claiming the trial court erred by: (1) failing to find that Short’s actions terminated the written agreement between the parties, (2) awarding Short damages for lost income, and (3) finding…
