VAN VALKENBURGH, Circuit Judge.

Appellee is a New Jersey corporation licensed to do business in the state of Missouri and engaged in mining operations at Joplin in said state. Some time prior to May 14, 1927, appellee was pamed as lessee in a mining lease covering the following described property:

“All of the Southeast Quarter (S. E. %) of the Northwest Quarter (N. W. *4) of Section Fourteen (14) Township Twenty-nine (29) Range Thirty-four (34) containing Forty (40) acres more or less.”
