The complainant, on February 10th, 1926, filed her bill in this court alleging cruelty and praying for a decree of separate maintenance. She obtained decree against defendant November 7th, 1928.

On February 23d 1932, the defendant filed suit for divorce from complainant in the second judicial district court of Nevada, alleging that complainant and he were separated since January 2d 1926, since which time they did not live or cohabit together.
