Appeal from a judgment of the Supreme Court (McDonough, J.), entered April 29, 2010 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of the Board of Parole revoking petitioner’s parole.

In January 2007, petitioner was convicted of the crimes of attempted criminal possession of a controlled substance in the third degree and criminal possession of a weapon in the third degree.
