This is an appeal by the No East-West Highway Committee, Inc. (“NEWHC”) from a decision by the United States District Court for the District of New Hampshire denying NEWHC’s motion for a preliminary injunction to restrain the appellee, John P. Chandler, the New Hampshire Highway Commissioner, from proceeding with the Marlborough Route 101/Main Street Highway Project (“the Project”) on the grounds that it is a “major Federal action” that cannot be undertaken without the prior preparation of an Environmental Impact Statement (“EIS”).
