Affirming.

The Bailey Construction Company sued A. B. Cor-nett, seeking to enforce a lien for street improvements on *269certain abutting lands owned by Cornett, in Harlan, a city of the fourth class.

The lower court sustained a demurrer to the petition and dismissed it. Upon appeal to this court that judgment was reversed in an opinion reported in 198 Ky. 143. On a return of the case the issues were completed by appropriate pleadings and evidence taken.
