ORDER DENYING MOTION TO DISMISS
RYSKAMP, District Judge.
THIS CAUSE comes before the Court pursuant to Defendant QBE Insurance Corp.’s Motion to Dismiss, filed March 7, 2007 [DE 16]. Plaintiff Townhouses of Highland Beach Condominium Association, Inc. responded on March 21, 2007 [DE 20]. Defendant QBE Insurance Corp. did not reply. This motion is ripe for adjudication.
