In August of 1972, the appellants, Norton and Kathy Clore, filed a “class action” for themselves and all tenants in their apartment building against their landlord, Harry Fredman, the City of Peoria, and the Director of Environmental Development of the City of Peoria, seeking declaratory and injunctive relief to prevent their landlord from evicting them and to require him to repair his rental property to meet minimum requirements of the Peoria Housing Code.
