McGRANERY, District Judge.

The plaintiff has filed a complaint seeking a preliminary and final injunction on the ground of patent infringement. Defendant denies infringement, and also denies the validity of the patent in suit. The answer sets forth this position in several affirmative defenses, and a counterclaim containing substantially the same allegations asks for a declaratory judgment that the patent is invalid “and/or” not infringed.
