On August 30, 2001, Robert Rebar and his wife Margo Rebar sued Cook’s Pest Control, Inc., James Aycock, Dannie McClusky, and Harold Pinckard. 1 The complaint alleged fraudulent misrepresentation, fraudulent suppression, negligence, negligence per se, breach of contract, negligent misrepresentation, unjust enrichment, failure to warn, and negligent training, supervision, and retention of employees. 2 The complaint was later amended to add a bad-faith claim, but that claim was ultimately withdrawn.
