This case is submitted upon an agreed statement of facts. The facts were about as follows:

That on the 27th day of May, 1892, A. M. Cannon and Jennie F. Cannon, his wife, who were the owners in fee simple of certain lots in Spokane Falls, for a valuable consideration executed and delivered to the plaintiff (appellant herein), the German Savings and Loan Society, a mortgage upon said lots, together with all and singular the tenements, hereditaments and appurtenances thereunto belonging, or in any wise appertaining.
