This is an action in' equity for the purpose of adjudging a trust to exist in favor of the plaintiff and for an accounting and that the plaintiff’s claim be preferred over the claims of the general creditors of the insolvent Carnegie Trust Company. The predecessor of the plaintiff was the Van Norden Trust Company, a corporation duly organized and existing under and by virtue of the Banking Laws of the' state of New York.
