BARRON, Justice.
This is an appeal from an order of the District Court of Brazoria County overruling a plea of privilege filed by the defendant, J. Weingarten, Inc. Plaintiff, Ted Heatherly, filed suit alleging that on or about November 11, 1968, he was injured while working in the course of his employment for J. Weingarten, Inc. in defendant’s store located in Texas City, Galveston County, Texas.
