On February 24, 2010, following a default by the Defendant Hobré Instruments BV (“Hobré”), United States Magistrate Judge Arlene R. Lindsay issued a Report and Recommendation finding that Cosa Instrument Corporation (“Cosa”) and Xentaur Corporation (“Xentaur”) (collectively “the Plaintiffs”) were not entitled to the declaratory and injunctive relief or the attorneys’ fees that they requested in connection with Hobré’s default.
