Appellant-plaintiff Herschel Gulley appeals the trial court’s grant of summary judgment in favor of appellee-defendant Frederick C. Winter. Gulley presents several issues for our review, which we consolidate and restate as follows: (1) whether the trial court properly concluded that the Journey’s Account Statute 1 did not require it to give effect to a federal court order allowing an amendment to a complaint when the federal action was subsequently dismissed for lack of subject matter jurisdiction; and (2) whether the trial court properly determined that the amendment to…
