This is an appeal from two judgments in the consolidated cases of Orpha Fuller et al. v. W. H. Ostruske et al. (hereinafter referred to as the contract action), and State ex rel. Liening et al. v. Pacific Alaska Contractors, Inc. et al. (hereinafter referred to as the mandamus action). Both actions involve share certificates Nos. 1 and 4, for forty and forty-five shares, respectively, constituting one third of the outstanding stock of Pacific Alaska Contractors, Inc., an Alaska corporation.
