At the January Term, 1977, of the Circuit Court of Jefferson County, the grand jury returned an indictment charging the appellant, Donald G. Rissler, Jr. with breaking and entering the High’s Dairy Products Store, located in the Town of Ranson, in Jefferson County. After entering a plea of not guilty, the appellant was tried before a jury on March 16, 1977j and found guilty as charged in the indictment. Appellant’s motion to arrest judgment, set aside the verdict, and grant a new trial was denied and he was sentenced to an indeterminate term of one to ten years in the State…
