OPINION

ROTH, District Judge.

This is a patent infringement action filed by plaintiff Friction Division Products (“FDP”) against defendant E.I. DuPont de Nemours & Company (“DuPont”). Plaintiff, FDP, charges DuPont with infringing and inducing others to infringe United States Patent No. 4,374,211 (“’211 Patent”). DuPont has denied the allegations of patent infringement and inducement to infringe and has counterclaimed seeking a declaratory judgment that FDP’s patent is invalid, unenforceable and has not been infringed.
