Plaintiff--respondent Darryl Wagner was riding as a guest in an automobile driven by Donald Graham Osborn. In attempting to negotiate a curve on the river road between Sacramento and Woodland the car left the highway and collided with a tree. Donald Graham Osborn was killed in the tragic accident and plaintiff was injured. Action was brought in the Superior Court of Tolo County against defendant-appellant, Matt G. Osborn, as administrator of Donald’s estate. A trial was had and the jury returned a verdict for plaintiff in the sum of $6,000. Judgment was entered against…
