This is an appeal upon questions of law from a judgment of the Court of Common Pleas of Cler-mont County in a suit for the specific performance of a contract to sell real estate.

Delsie Ellison, defendant below but not an appellant, owned real estate in Williamsburg, Ohio, and listed the parcel for sale with an agent.
