MEMORANDUM RULING

HICKS, District Judge.

Before the Court is a Motion for Summary Judgment (Record Document 314) filed by Defendants, Jack B. Binion (“Bin-ion”), Horseshoe Entertainment, L.P., Horseshoe Gaming Holding Corporation, and New Gaming Capital Partnership, Inc. Defendants move for summary judgment dismissing all of Plaintiffs’ claims on the grounds that there is no genuine issue of material fact and that they are entitled to summary judgment as a matter of law.
