I. INTRODUCTION
Plaintiff Melinda Mayhew (“Mayhew”) commenced this action for declaratory, injunctive, and monetary relief pursuant to § 502(a)(1) of the Employee Retirement Security Act (“ERISA”), 29 U.S.C. § 1132(a)(1), against Defendants Hartford Life and Accident Insurance Company (“Hartford”) and Formfactor, Inc. Group Welfare Benefit Plan (collectively, “Defendants”). ECF No. 1 (“Compl.”) ¶ 1. In answering the Complaint, Hartford asserted a Counterclaim for restitution. ECF No. 16 (“Counterclaim”) ¶¶ 67-72.…
