This is an appeal from a judgment of the district court of Fallon County, which judgment ordered the appellant, Mon*3tana Livestock Commission, to issue forthwith a Certificate of Public Convenience and Necessity to the respondent, Baker Sales Barn, Inc., upon the filing of satisfactory bonds required by the rules of the Commission.

The cause arose out of an application by the respondent to the appellant Commission for a Certificate of Public Convenience and Necessity authorizing the licensing of a livestock market at Baker, Montana, under the provisions of R.C.M. 1947, § 46-908, et seq. There…
