OPINION
DONALD RUSSELL, Circuit Judge:
The Director, Office of Workers’ Compensation Programs, (“Director”) has filed a petition for rehearing and suggestion for rehearing en banc, seeking reconsideration of our recent opinion in this appeal. The relevant facts are fully discussed in our primary opinion, 954 F.2d 239. Briefly, the case involved a claim for benefits filed under the Longshore and Harbor Workers’ Compensation Act, 33 U.S.C. §§ 901-950 (1988), for serious injuries sustained by William Sellman.
