Lucas, Judge :

On writ of error from the Circuit Court of Greenbrier county. On the 7th of April, 1884, the plaintiff, J. J. Live-say, recovered ajudgment against the defendant, J. R. Dunn, in a justice’s court, for $281.38, and, no execution having issued thereon, the plaintiff brought an action on the judgment before the same justice, on the 26th day of May, 1888. The justice decided the case against the plaintiff, and dismissed his action.
