LINDLEY, District judge.

Defendant appeals from a judgment of conviction of a charge of violation of Section 301(a) of the Federal Food, Drug, and Cosmetic Act, 21 U.S.C.A. § 301 et seq., entered after trial without a jury, largely upon stipulated facts.

Section 301(a) prohibits introduction into interstate commerce of any food, drug, device, or cosmetic which is “adulterated, or misbranded.” Anyone violating this en actment is subject to prosecution under Section 303(a), reading: “Any person who violates any of the provisions of section 301 shall be guilty of a misdemeanor and shall on…
