Appeal by the plaintiff, Edward R. Satterlee, from a judgment of the Supreme Court in favor of the defendants, Alice L. Kobbe and others, entered in the office of the clerk of the county of Jefferson on the 25th day of. Hay, 1901, upon the dismissal of the complaint by direction of thé court after a trial at the Jefferson Trial Term.

The judgment appealed from should he affirmed, with costs.

The action was brought for the partition of real property. If was alleged in the complaint and stated in the opening by counsel that some of the defendants other than the six respondents were tenants in common with the plaintiff of the real property; that the six respondent defendants were not tenants in common with the plaintiff, but claimed title to portions of the real property adversely to the plaintiff, and would not be tenants in. common with the plaintiff, whether their claims were held valid or invalid; that their…
